Because we have historically worked on a contingency fee basis our business model forces us to minimize wasted time and effort. Our information-sharing case management system keeps everyone on the same page and allows us to reach successful litigation outcomes as expeditiously as possible.

We have invested in the latest technology to assist us in discovery. This includes document management programs and all of the latest hardware to efficiently manage cases involving hundreds of thousands of documents. Again, because of our preference for contingency fees, our business model requires us to find the most efficient ways to get a case through the discovery phase while obtaining all of the material evidence we need to succeed at trial.

Visual and communications experts seem to agree that there have been significant changes in the last 30 years in the way people acquire information in their day to day lives. This change has impacted many industries whose goal is to advocate a position from advertising to political campaigns. Yet, trial lawyers have been reluctant to radically change the tried and true approaches that have been used for the past century. The time has come, however, for trial lawyers to recognize the handwriting on the wall and endeavor to tell their stories in the manner that jurors will better accept, understand and retain them.

At Faraci Lange we have embraced this future by utilizing the latest in trial presentation software and techniques. Another benefit of trying more cases than anyone else has been our mastery of this technology to assist in reaching jurors in the most effective way possible. Studies show that 75%-85% of people today predominantly learn information visually while the remaining much smaller proportion rely predominantly on the auditory channel. This trend has carried over to juries as well. Today’s jurors are accustomed to spoon fed images and visual communication has become more prevalent and powerful. As one expert has described it:

“Constant inundation of visual stimuli means that when appropriate visual images do not accompany the verbal story being told about the case, juror’s memories will fill in with the available images retrieved from personal archives. If lawyers don’t want jurors filling in the blanks in the mind’s eye with the most immediate images provided by the media, they need to adapt.”i
